Negligent Discharge of a Firearm

On March 29, 2021, at about 12:03 a.m., Chico Police Officers responded to the Hidden Oaks Apartments at 650 Hickory Street. A victim reported his unoccupied vehicle had been struck by gunfire. Another victim was on scene and reported his vehicle had also been struck by gunfire four days prior. Through investigation officers determined the gunfire likely originated from an adjacent apartment complex at 1521 W. 5th Street. Additionally, Officers found a residence on W. 5th Street that had also been struck by gunfire.

Officers attempted contact at 1521 W. 5th Street, they located additional evidence of gunfire. Officers spoke with a resident of the complex, Zachery Wallace (age 42). Officers were able to conduct a search of Wallace’s apartment. Officers recovered a loaded .40 caliber Glock handgun and about 200 rounds of ammunition. Wallace was determined to be a felon; therefore, he is prohibited from possessing or purchasing a firearm. At the conclusion of the investigation officers determined Wallace had fired the handgun from his apartment on several different occasions. Wallace was arrested for violations of sections 29800(a)(1) PC-Felon in Possession of a Firearm, 30305(a)(1) PC-Felon in Possession of Ammunition, and two counts of 246.3(a) PC-Discharge of a Firearm in a Grossly Negligent Manner. Wallace was booked into the Butte County Jail on the listed violations.
