Assault with a Deadly Weapon

Twas the night before Christmas and the Chico Mall was bustling with last minute shoppers. At about 3:35 p.m. a victim called Chico Police Dispatch. He said a subject just pulled a gun on him in the mall parking lot after a road rage incident. An officer arrived on scene and spoke with the victim. He said the suspect, later identified as Cristian Delacruz, confronted him in the parking lot. Delacruz walked up to the driver’s window of his car and they exchanged words. During the exchange of words Delacruz pulled a handgun out of his waistband, cocked it, stuck it inside the victim’s open driver’s side window, and pointed it at the victim’s head from about 1 foot away.

Responding officers canvassed the area. A possible suspect vehicle was found in the parking lot near Chili’s Restaurant, it was unoccupied at the time. Then, officers were approached by a 71-year-old man. This gentleman said he was driving through the parking lot and honked his horn at Delacruz, who was blocking him from driving through the lot. Delacruz turned and pointed a handgun at him, and the gentleman drove away.
As officers were processing the scene two subjects walked toward the suspect vehicle. They were detained. Cristian Alexander Delacruz (23) was one of the subjects. Delacruz was positively identified by witnesses as the suspect with the firearm. Officers searched Delacruz and only found a switchblade knife in his possession. Officers searched the suspect vehicle and recovered two 9mm handguns, ammunition and a holster.

Delacruz was arrested for two violations of 245(a)(2) PC – Assault with a Deadly Weapon, a violation of 25400(a)(2) PC – Carrying a Concealed Firearm, and a violation of 21510(b) PC – Possession of a Switchblade Knife. Delacruz was booked into the Butte County Jail.
